Maseru, Oct. 13—- Advocate Fusi Sehapi has on Monday told the Court of Appeal that the courts of Lesotho have jurisdiction over acts or omissions committed by the Government of Lesotho.
This he said when arguing an appeal in which Basotho Covenant Movement (BCM) and the wife of the incarcerated party leader Dr. Tsépo Lipholo, ‘Mathapelo Lipholo, are challenging a decision by the High Court.
The appellants had approached the High Court seeking to block a planned arrest of Dr. Lipholo by the governments of Lesotho and South Africa. The High Court declined jurisdiction hence the current appeal.
Adv. Sehapi argued that the High Court erred and misdirected itself by refusing to hear merits of the case on the basis that it lacked jurisdiction. He stated that the court has jurisdiction because of the alleged acts which they wanted to arrest Dr. Lipholo for, happened inside Lesotho where it has jurisdiction…
