Maseru, Sept.04—– Katiso Senoko who is currently standing trial for the murder of Kapotene Mokone which occurred at Ha Moruthoane in February 2019, says it was not his intention to kill the deceased.
This he told the court while testifying after the prosecution closed its case.
He stated that he acted in self defence adding that the deceased started a fight with him. He denied that he used excessive force on the deceased who was not armed. He said the deceased had a stick with him adding that a knife also fell from him while they were fighting.
The accused testified that on the fateful day when he went to a bar he had a stick in his car for protection as he had recently been robbed. He stated that he saw the deceased near the window of the bar adding that he was full of rage and said he heard all the nonsense that was said about him.
Evidence has shown that there was a misunderstanding between the accused and the deceased as the deceased was suspected to be responsible for theft which occurred at the accused’s shop and they had earlier had a confrontation.
The accused told the court that Keketso Mputsoane tried to send the deceased away and while at it he sneaked to his car and came back with a stick. He said the deceased came back running towards him and tried to hit him with the stick, and eventually succeeded as they were fighting.
He pointed out that after he saw the knife fall from the deceased, he intensified the fight and managed to overpower him. He said he hit him with the stick after which he fell. He told the court that he then dropped the stick and ran into the bar.
The accused testified that as he was trying to get hold of the police, Teboho Poone told him that they have already been called and are on their way. He said when the police arrived, they were briefed about the events by Keketso Mputsoane. He indicated that when they went to a place where the deceased was, the police declared him dead.
He informed the court that he could not believe it, adding that nothing made sense at that time. He said when he regained consciousness, he was at a police cell in Morija where they told him that he was under arrest for the murder of the deceased.
The case is before Justice Tseliso Mokoko.
