Maseru, Apr. 24 — Advocate Khosi Lesuthu has on Thursday told the Court of Appeal that the High Court was wrong to have convicted Jobere Kelane of murder.
Kelane was in 2023 found guilty of the murder of Moeketsi Ntsasa whom he burned to death at Ha Jimisi in Mazenod in 2008. The murder occured following a citizen’s arrest on the deceased for allegedly stealing at a shop belonging to the accused who is currently appealing against his conviction.
He was sentenced to 13 years imprisonment and directed to compensate the family of the deceased with M10,000.00.
Adv. Lesuthu argued that the prosecution erred by charging one person yet the offence was committed by a mob. He added that the prosecution even brought evidence of mob justice yet only the accused/appellant was convicted. MM/TL
