Maseru, Jul.28 – The High Court sitting as the Constitutional Court through Justices Malebona Khabo, Tseliso Mokoko and Moneuoa Kopo says each judge has taken an Oath of Office to dispense justice without fear or prejudice.
This the Court said on Monday in a judgment dismissing an application by the suspended Director of Public Prosecutions (DPP) Hlalefang Motinyane in which she sought recusance of the three judges presiding over her review application.

Adv. Motinyane has approached the court seeking that the proposed move by the Prime Minister to advise the King, pursuant to Section 141 (6) of the Constitution of Lesotho, 1993 to set up a tribunal to investigate allegations against her, be declared unconstitutional.
The Court stated in the judgment that the judges have taken an oath to uphold the Rule of Law and the Constitution of Lesotho.
It added that it is their responsibility to impartially and faithfully administer justice while ensuring that their personal biases or external pressures do not influence their decisions.
It added that judges constantly demonstrate that their loyalty runs to the Constitution of Lesotho and none other.
