BOLOETSE CHALLENGES DECISION OF COURT

Maseru, Aug.29 – An Activist Kananelo Boloetse who had instituted an unsuccessful litigation against reinstatement of 11th Amendment to the Constitution Bill of 2022 by the 11th Parliament has filed an appeal before the Court of Appeal challenging the decision of the High Court sitting as the Constitutional Court.

The application before the Constitutional Court which was instituted by Mr. Boloetse together with Yearn for Economic Sustainability (YES) and Media Institute of Southern Africa (MISA) Lesotho which the court ruled that they do not have locus standi, was dismissed. The court stated that the 11th Parliament is in session, only that it is on winter adjournment.

It said the Parliament has been recalled to invoke its legitimate and constitutional powers in terms of Standing Order No. 105B to reinstate the business which fell with the dissolution of the 10th Parliament. It indicated that it is well within the powers of the 11th Parliament to reinstate the unfinished business of the 10th Parliament.
