Maseru, Jun.02—–The Court of Appeal in its special sitting, has
issued an interlocutory order directing that proceedings before the
High Court in which appointment of Vice Chancellor of the National
University of Lesotho is being challenged by its Pro-Vice Chancellor
Professor Kananelo Mosito, should be stayed pending finalisation of
the appeals challenging the decisions of the High Court.
NUL and its Council have approached the Court of Appeal on urgent
basis seeking stay of execution of a court order directing that
hearing of merits in the matter before the High Court be proceeded
with. The order came after the High Court through Justice Molefi
Makara ruled that it has jurisdiction to entertain the matter. The
same Court also dismissed an application that sought recusal of the
judges of the High Court to hear the case.
Apart from directing the stay of the proceedings before the High
Court, the Court of Appeal has ordered that the ‘purported ongoing
recruitment, selection and appointment process for the office of the
Vice- Chancellor of the National University of Lesotho, including all
steps taken pursuant thereto, is hereby stayed pending the final
determination of the substantive proceedings before the High Court.
” For the avoidance of doubt and to preserve institutional and to
preserve institutional continuity and ensure fidelity to the statutory
scheme established by the National University of Lesotho Order, 1992,
it is hereby declared that, upon the occurrence of a vacancy in the
office of Vice-Chancellor on 31 July 2026, section 17 (4) of the Order
shall take effect according to its terms”, said the Court of Appeal…
