COURT TO BE UPDATED

Maseru, Apr. 06 — After having issued directives for parties in a case between United for Change (UFC) and its Member of Parliament (MP) Mr. Mohlominyane Tota to correct the application as it had some errors and not ready for hearing, the court is yet to be updated on status of the case before a hearing date can be set.  

Legal Representative for the applicants in the matter Adv. Fusi Sehapi has confirmed that corrections that were sought have been made and proper papers already filed with the court. 

The applicants in this matter, UFC and its leader Mrs. Malichaba Lekhoaba have approached the court requesting it to review, correct and set aside a decision by the Speaker of the National Assembly in which it ruled that  Mr. Tota has not crossed the floor but simply changed seats. They asked that the court should order that the decision is irregular and unlawful.  

They also asked for a declarator that the movement of Mr. Tota from the government side/seat to the opposition side/seat constituted floor crossing and occasioned a vacancy in the UFC seat. They further requested an order that the seat of Mr. Tota in the National Assembly has become vacant.
