COURT TO HEAR ARGUMENTS

Maseru, Sept.11 — The High Court through Justice Charles Hungwe will on September 29 2025 hear arguments on an application for discharge in a case in which nine members of the army including Former Army Commander Lieutenant General Tlali Kamoli are charged with the murder of Maaparankoe Mahao.

The defence in this matter has moved the application for discharge after the prosecution closed its case.

According to section 175 (3) of Criminal Procedure and Evidence Act  of 1981,  ‘If at the close of the case for the prosecution, the court considers that there is no evidence that the accused committed the offence charged in the charge, or any other offence of which he might be convicted thereon, the court may return a verdict of not guilty’.

The last witness to testify in this matter is Inspector Lebohang Motanya who was part of an investigation team into the matter. He took the stand after the wife of the deceased ‘Mamphanya Mahao.

The accused in this matter are alleged to have shot and killed Mahao on June 25 2015 at Ha Lekete in Mokema. They are also facing several other charges in relation to this matter.

The prosecution is represented by Advocates Rethabile Setlojoane and Lehlohonolo Phooko while the defense team is made up of Advocates Letuka Molati, Qhalehang Lestika, Silas Ratau, Napo Mafaesa and Kabelo Letuka.
