FEDERATION OPPOSES BAIL FOR MURDER ACCUSED IN HIGH-PROFILE CASE

Maseru, Apr. 21 — The Federation of Labour (FELETU) has strongly opposed the possible granting of bail to murder accused Foliki Makhutle, citing concerns over public safety and the integrity of the justice system.

In a statement released today, the Federation emphasised that while Lesotho law guarantees every accused person the constitutional right to apply for bail, such a right is not absolute. The organization noted that bail decisions remain at the discretion of the courts, particularly in serious cases where there may be risks to society or the judicial process.

The case relates to the alleged killing of Nurse Morephe Santi, which has sparked public concern and calls for justice. The Federation argues that the accused’s reported history of violent crime raises serious questions about his suitability for release on bail. It claims that previous allegations of similar offenses suggest a pattern that could endanger the community if he is released.

Further concerns have been raised about the potential for interference with witnesses. The Federation warned that the gravity of the charges, combined with the accused’s alleged past behavior, increases the likelihood of witness intimidation, which could undermine the fairness of the trial.

Highlighting the severity of the charge of murder under Lesotho’s Penal Code, the Federation maintains that denying bail would serve the interests of justice, protect the public, and reinforce confidence in the legal system.

The High Court is expected to consider the bail application on April 21, 2026. The Federation has called on workers and members of the public to show peaceful support for its stance and to stand in solidarity with the family of the deceased.

Meanwhile, the accused remains entitled to a fair trial, in line with constitutional protections and the presumption of innocence until proven guilty.
