RELIEFS SOUGHT DECLINED WITH COSTS

Maseru, Mar. 27 — The High Court through Justice Keketso Moahloli has ruled that interim reliefs sought by Former Commissioner of Police, Mr. Holomo Molibeli who is suing the Lesotho Times Newspaper, are declined with costs.

This follows arguments on urgency whereby the applicant requested that the case be dealt with on an urgent basis while the respondents argued that the matter should follow the normal court process.

In his ruling, the judge stated that in the current case, the applicant seeks to use the rule nisi procedure without any acceptable justification. He indicated that his application is neither exparte nor intended for persons he has difficulty identifying for serving. He pointed out that he has no reasonable cause to not follow procedure in the usual manner to grant the rule nisi.

Mr. Molibeli had filed an application against Africa Media Holdings (PTY) LTD, Letuka Mame and the Lesotho Times after they published what he said is a defamatory material and information about him adding that they refused to retract or apologise when demanded to do so.
