FAILURE TO COMPLY WITH CHALLENGE, PROCEDURE POSES DANGER-WITNESS

Maseru, Nov.13—Seageant Tjekane Sebolai, one of the defence witnesses, also one of the accused charged with the murder of Lisebo Tang which occurred on May 09 2014 near the home of Retired Army Commander Lieutenant General Tlali Kamoli, says failure to comply with a challenge and procedures poses danger.

This he said during his cross-examination adding that when an enemy shows signs of danger, it has to be eliminated.

Sebolai is charged together with Private Selone Ratsiu who was with him on a night duty at the residence of Kamoli on May 09 2014. It is alleged that  they shot and killed Lisebo Tang  who was in the company of Tsépo Jane who survived the shooting with injuries. It is further alleged that they also damaged the vehicle belonging to Jane by shooting at it. 

The accused told the court that when the occupants of a white double cab which they perceived to be an enemy did not respond to the challenge they tried to capture it as per orders before they could eliminate it.

” The order was clear: capture the enemy, if it resists or flees, eliminate it”, he said adding that in that situation, he and his co-accused decided to eliminate the enemy when it fled.

He was told by the prosecutor Advocate Motene Rafoneke that the perceived enemy had not posed any form of danger to them…
