WOMAN SLAPPED WITH 10 YEARS IMPRISONMENT

Qacha’s Nek, July 25 — Qacha’s Nek Magistrate Court Magistrate, Mr. Ts’eliso Bale has sentenced a 34 year-old woman to 10 years imprisonment without an option of a fine for assaulting  her 9 years old son with a  4-pounds  hammer.

The woman pleaded guilty  saying she was  offended after she discovered that he ate the last food of his sibling which she could not get again unless she sold wood again, which is her means of survival.

“I did say if he had died it would have been better but it was out of anger. As a first time offender, I pray the court pardon me,” she said.

Mr. Bale said the accused was found guilty of attempted murder as charged in contravention of the provisions of Section 44 (1) of the Children Protection and Welfare Act, 2011.

Evidence given showed that the accused on July 4 beat her 9 years old son with a  hammer on the head thereby causing him physical injuries and did commit the offense.

The child was seen crying, bleeding and swollen on the above mentioned date by her grandmother, whom he stays with.

Section 44 (1) of the Children Protection and Welfare Act states that a person who abuses, neglects, abandons or exposes a child in a manner likely to cause the child physical, psychological or emotional injury or causes commits an offence and is liable on conviction to a fine or to imprisonment.
