COUNCIL OF STATE ACTION UNCONSTITUTIONAL-COURT 

Maseru, Oct.07— The High Court exercising its Constitutional jurisdiction in its judgment says failure by the Council of State to deliberate and or adjudicate over the Basotho Action Party’s (BAP) complaint in support of a recommendation for establishment of a tribunal to probe the fitness of the commissioners of the Independent Electoral Commision (IEC) is unconstitutional. 

This the court said following an application by some political parties in which they were challenging the fitness of the commissioners of the Independent Electoral Commission (IEC) to hold office. The applicants complained that the Council of State was unwilling to react to calls for intervention which have been made to them through several correspondences.
