DEFENCE CHALLENGES ADMISSIBILITY OF CONFESSION

Maseru, Feb.26—-The defence in a case in which Mohlahli Motseki of Taung in Mohale’s Hoek is charged with the murder of Mpho Kholoane which occurred at Siloe on June 12 2016, has challenged admissibility of a confession made by the accused in the matter.

They insisted that the accused was tortured by the police and forced to make the confession. They stated that he was not free adding that he did not make the confession voluntarily therefore it should not be admitted as part of evidence by the court.

The court held a trial within trial in order to establish the admissibility of the said confession. The prosecution then let evidence from Magistrate  Matsotello Mary Khechane-Tsilo who was working at the Mohale’s Hoek Magistrate’s Court in 2016…
