GOVERNMENT FAILS TO FILE, ASKS TO ARGUE LAW

Maseru, Oct. 31 — Legal Representative for the government in a Constitutional Case in which a Member of Parliament for Thaba Moea Constituency No. 73, Mr. Lejone Puseletso is challenging a motion of no confidence in the Government of Lesotho, on Tuesday told the court that they have not filed their heads of arguments and therefore requested to argue the law only.

Advocate Thomas Thakalekoala who is representing the Speaker of the National Assembly, Clerk of the National Assembly, Prime Minister, Minister of Constitutional Affairs and the Attorney General who have been cited as first to fifth respondents in the main application stated that although they have not filed anything formal, they had initially indicated to the court and other parties in the matter that they intend to oppose the application.

He stated that it will be in the interest of justice that they be allowed to argue and assist the court to reach a decision.

Legal representative for some of the respondents Adv. Monaheng Rasekoai stated that the case is of national importance adding that it has to be done by the rule and law. He indicated that it is unprocedural for the state to argue as if they have opposed the case. He insisted that things have to be done procedurally. . .
