SEMPHETHENYANE RESIDENTS GRANTED BAIL

Maseru, June 04 — Six Semphethenyane accused have been granted bail on their own recognisance after appearing before Magistrate Mohlomi Qhomane on Wednesday on charges related to public disorder and alleged conduct likely to incite public violence.

The accused are Khabane Pali (40), Thabeng Mofolo (27), Putsoeli Rampoba (50), Lerata Matsosa (54), Molupi Potsane (47), and Maboitumelo Mohale (50).

According to the charge sheet, on Count 1,  the accused allegedly acted unlawfully and intentionally on June 1, 2026, at Semphethenyane in the Maseru district by conducting themselves in a manner and uttering words that created a real likelihood of leading to public violence. It is alleged that they sang offensive songs and burned tyres in the middle of a public road, thereby obstructing its use.

The prosecution further alleges that the accused’s actions were such that the natural and probable consequences could have resulted in public violence by members of the public.

On count 2 , the accused  persons are charged with allegedly acting in concert and in furtherance of a common purpose by using obscene, abusive, threatening, or insulting words in a public place with the intention of provoking a breach of peace, or in circumstances where a breach of the peace was likely to occur.

Advocate Nthontho, appearing on behalf of all six accused, applied for their release on bail. He submitted that the accused had been part of a community gathering protesting the poor condition of a road, which residents consider an essential public service.

He told the court that the Minister of Local Government had acknowledged concerns about the state of the road and informed residents that the project is expected to be included in the 2027 budget.

Advocate Nthontho further argued that the accused had cooperated with the police after being instructed to report to the station. He said they have fixed places of residence and do not pose a flight risk.

He also maintained that the charges are not of such a serious nature as to warrant fears that the accused would abscond and therefore requested that they be released on bail of recognisance.

Magistrate Qhomane granted the accused bail on their own recognisance.

The accused are remanded to June 29 2026.
