Qacha’s Nek, Dec. 17 — The Qacha’s Nek Magistrate Court has sentenced 41 year-old Ts’okolo Khauoane of Lebakeng, Ha Senarile, to 10 years in prison without the option of a fine for raping his 26 year-old mentally handicapped cousin.
Delivering the judgment, Senior Magistrate Ts’eliso Bale noted that while Khauoane was a first-time offender and had saved the court’s time by pleading guilty, the gravity of the crime warranted a severe sentence.
The incident occurred on November 1 and violated Section 15 (1) (a) read with 32 (a) (vi) of the Sexual Offenses Act No. 3 of 2003.
Public Prosecutor Advocate Tsotang Maile accepted Khauoane’s guilty plea but revealed that a crown witness caught him in the act.
