CASE FAILS TO PROCEED 

Maseru, Oct.13 — Hearing of a case in which some army members are accused of killing three men at Mafeteng in 2012 which was set for Friday could not go ahead as scheduled because Presiding Judge Justice Polo Banyane is now one of the Acting Judges of the Court of Appeal which is currently sitting. 

The case fails to proceed as some of the accused in the matter remain in the dark regarding their bail application as ruling on it remains pending.  

The accused have asked the court to release them on bail pending finalisation of the case against them. They have in the application argued that there has been an unreasonable delay in the trial adding that there are exceptional circumstances that warrant their release on bail.
